Understanding the Court Structure in Dubai

Filing a Claim at the Dubai Onshore Courts

When a dispute falls under the jurisdiction of the Dubai onshore courts, the litigation process typically begins at the Court of First Instance (CFI). To initiate legal action, the claimant must prepare and file a comprehensive statement of claim along with supporting evidence.

Key steps include,

  • Submission of the claim to the CFI
  • Appointment of a Power of Attorney (POA) for legal representation
  • Payment of the court filing fee, calculated as a percentage of the amount claimed

The claim will then be assigned to either the minor or major circuit, depending on the value and complexity of the matter.

Once filed, the claim is served on the defendant via personal service. If personal delivery proves unsuccessful, the court may authorize alternative service methods to ensure the defendant is properly notified.

Responding to a Claim and Pleadings

After service of the claim, the defendant is granted an opportunity to respond by filing,

  • A defence
  • A POA, if represented
  • A counterclaim, if applicable

The court allows flexibility in pleadings. There is no fixed number of submissions, as the presiding judge controls the progression of the case, including hearings, document exchange, and adjournments. This ensures each party is granted a fair opportunity to present their case.

Expert Appointments and Evidence

In many cases, the court may appoint an independent expert to assist in establishing the facts, analyzing documents, and preparing a technical or financial report. These reports carry significant weight and often guide the judge’s decision-making.

Any party may request expert appointment; however, the requesting party generally bears the associated cost. Experts play a key role, particularly in disputes involving construction, real estate, or financial matters where technical analysis is essential.

Timelines and Appeal Process

A judgment from the Court of First Instance may be issued within 12 months of filing the claim. Complex matters or delays in expert reporting can extend this timeline.

Once a judgment is issued, parties have 30 days to file an appeal with the Court of Appeal. This court reviews the case based on errors in fact or law made by the lower court. The appeal process involves another court fee and further pleadings.

The Court of Appeal generally issues its judgment within six to nine months. If further review is necessary, a final appeal can be made to the Court of Cassation, the highest court in Dubai. Appeals to the Court of Cassation must be filed within 60 days of the appellate judgment.

This court only reviews legal errors and does not reassess the facts. The Court of Cassation judgment is final and binding, typically delivered within three to six months.

Enforcement of Judgments in Dubai

Once a judgment becomes final, enforcement is carried out through the Dubai Court’s Enforcement Department. This stage is crucial for recovering monetary awards, assets, or contractual performance.

Execution is only possible if the debtor holds assets within Dubai. If the debtor fails to comply voluntarily, the enforcement process will begin, involving asset identification, account freezing, or property seizure.

Before commencing litigation, it is essential to assess the debtor’s financial position and asset location to ensure the claim can be successfully enforced after judgment.
